Role Overview:
Based in our Washington offices, the Commercial Manager will be required to take full responsibility for commercial and contractual functions on contracts and projects within the Building Northeast and Yorkshire Business Unit throughout the North East region .

The job responsibilities and the position to whom the job holder reports, may vary from time to time; consequently, the job responsibilities will include but may not be limited to any or all the following items as required by the Business Unit Commercial Director.

Key Responsibilities:

  • Managing a team of quantity surveyors of all levels.
  • Management of individual performances including assistance in training, encouraging and disciplining where necessary.
  • Maximising profits and managing risks.
  • Support of senior management in ensuring continuous improvement in the areas of health, safety, environment and quality.
  • Support the bid and tender finalisation process to provide commercial input, including the review of contract terms, to identify opportunity and to mitigate risk.
  • Negotiate and agree changes to Main Contract terms and conditions, as required
  • Ensure agreed Main Contract terms and conditions align with the bid model.
  • Oversee the compilation and implementation of the project profit plan.
  • Ensure appropriate sub-contract 'template' agreements are in place across all projects and adhered to.
  • Enhance and maintain effective commercial control systems, procedures and standards to facilitate the continued profitable growth of the business whilst meeting the requirements of the statutory authorities and the Group. Such control will include but is not limited to:
    • Ensure accurate records are maintained for all projects and are stored, archived and handled in accordance with divisional policy.
    • Ensure accurate forecasting by the site team through monthly Cost & Value Reconciliations and Forecast Costs to complete.
    • Ensure Notices under the Main Contract and Subcontract are issued both correctly and in a timely manner.
    • Approve the content of all 'claim' notices.
    • Support the notification, preparation, submission, negotiation and settlement of all claims/dispute resolution.
    • Ensure variations are properly notified and valued.
    • Ensure the prompt settlement of Final Accounts.
    • Ensure the appropriate sub contract agreements are in place, approving any variations in terms.
    • Monitor, ensure and Audit for compliance with BMS.
    • Provide sound commercial and contractual advice to the project management team
    • Assist with the identification and implementation of the strategy for profit enhancement
    • Assist with the identification and implementation of the strategy for cash control and optimization to maximize the cash position of a contract
    • Ensure contractual compliance in all aspects affecting the business
    • Production of monthly reports highlighting key commercial and contractual issues.
    • Maintain standards of discipline that accord with the conditions of service.
    • Maintain and enhance effective commercial control systems to manage the continual profitability of the business, and for the management of risk
    • Devise project specific risk management procedures to be followed by the site based commercial team.
    • Subcontractor management
  • Attend Project cost review meetings to challenge commercial performance, reporting to the Commercial Director on areas of concern.
  • To work as part of the Senior Management team within the BU whilst encouraging a teamwork culture
  • To facilitate the delivery of commercial training in response to changes in legislation and best practice.

Experience and Qualifications:

  • Solid commercial background and proven track record within the construction industry in a Tier 1 Contractor
  • Degree qualified or equivalent
  • Professional qualification (e.g. RICS / CIOB)
