Commercial Manager role with Tier 1 Utilities Contractor on £1bn framework
About the role
The Commercial Manager will provide commercial and legal advice and support to the business. They will be a key advisor on contractual matters and related commercial risks and will provide advice and support to the operational teams on the contractual and commercial matters arising in the day to day operation of the business. They will also support the sales / pre-sales functions in relation to new business and work with the procurement team in relation to supplier matters.
Driving the development and implementation of robust business processes in respect to all booking and monies claimed
Ensuring all bespoke customer and supplier contracts are in place and Option’s position is protected
Developing and driving business commercial reporting
Drafting and negotiating variations to and change controls under such contracts.
Providing general pre-sales support including advice and support in relation to tenders and bid submissions, advice in relation to procurement processes and the procurement rules, assisting with clarification questions etc.
Ensuring systems are in place to monitor all outstanding customer payments and that totals are kept to minimum
Assessing the risk associated with contracting frameworks and determining the more effective contracting route.
Reviewing and interpreting complex contracts and supporting the business on matters of contractual interpretation and regarding contractual disputes and claims.
Providing general “in-life” support.
Drafting product terms and service level agreements and assisting the business to develop product collateral.
Identifying, managing and reporting on key commercial risks.
Ensuring that internal governance is complied with (for example relevant approvals are obtained, commercial criteria are met, registers are updated etc)
Knowledge and Experience
You will be degree qualified, preferably from a legal or business discipline.
Previous experience as a Commercial (Contracts) Manager from within the Utilities Sector would be an advantage.
Excellent drafting and negotiating skills (terms and conditions and contract schedules) without separate legal support
An excellent understanding of contract law and its application (in the context of commercial contracts)
The ability to manage and interpret complex contracts
The ability to manage and resolve contract disputes
The ability to provide commercial / legal advice at all stages of the contract process
Experience of developing product terms and collateral
Experience of developing business processes
Risk management skills
Excellent communication skills, both verbal and written
Confident with the ability to lead and influence
